By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. Any participation in this service will constitute acceptance of this agreement. If you do not agree to the above, please do not use this service.

 

This website is owned and operated by Alexandra Collingbourne for Sleep by Alexandra. These Terms set forth the terms and conditions under which you may use our website and services as offered by us.

 

This website offers visitors 1 to 1 sleep packages, digital downloads and free sleep resources. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

General

 

By working with you and your child, all Sleep by Alexandra programmes aim to support your child to sleep independently in the night. The methods I use will assist in this process.

 

However, I cannot guarantee that your child will sleep through the night without waking. As with all young children, it is natural and part of their sleep cycle that they wake in the night. What we will work towards is that when they wake, they are able to self-sooth. This will result in you not having to comfort them during the night.

 

My programmes and advice are based on qualifications, research and experiences, and therefore is my own advice to you. I am not medically trained, therefore if you have any concerns at all regarding your child’s health, you must seek medical advice from the NHS or a GP.

 

When buying an item, you agree that:
 

1.  you are responsible for reading the full item listing before making a commitment to buy it; and

2. you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

 

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Alexandra Collingbourne. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/ transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

 

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with. If you don't want to receive such promotional materials or notices – please just notify us at any time.

Personal information will be kept confidential at all times, expect in the case of a safeguarding issue regarding your child. A child’s welfare is paramount to me and if a safeguarding issue is flagged up, I will contact the necessary authorities as my duty of care.

 

Payment & Cancellation

 

Upon confirming that you wish to proceed with a sleep programme with Sleep by Alexandra, an invoice will be raised and payment will become due in full. Upon receipt of full payment we will then start the process of supporting you and your child through your tailored sleep programme.

 

All Sleep by Alexandra programmes require full commitment from both myself and the parents involved in order to achieve the goal of assisting your child to sleep. In providing you with a bespoke sleep package that best suits your needs, there is a lot of input and time that is taken during this process. Therefore if a programme is cancelled at any point, it will be at the discretion of Sleep by Alexandra if a refund, if any, is given.

 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your subscription and/or any services at any time.

 

You agree to indemnify and hold Alexandra Collingbourne harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

To the maximum extent permitted by applicable law, in no event shall Alexandra Collingbourne, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

  

To the maximum extent permitted by applicable law, Alexandra Collingbourne assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

Changes to Terms and Conditions

 

Sleep by Alexandra reserves the right to modify these Terms of Service at any time. Your decision to continue to visit and make use of the site after such changes have been made constitutes your formal acceptance of the new Terms of Service.

 

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the SBA site immediately.
